Bloggers' rights and risks are in legal limbo. This information describes the situation as of October 2007. It is also relevant for websites that express opinions or publish reviews, or companies that encourage employee blogging.
Why this is important to you: "It hasn't happened yet, but soon, there will be a blogger who is successfully sued and who loses his home. That will be the shot heard 'round the blogosphere." Media Bloggers Association
No assets you're "judgment-proof"? But are you planning to stay judgment-proof for life because judgments can be renewed, and if you lose a lawsuit (assuming you can afford to defend it in the first place), a plaintiff could be garnishing your wages and seizing your home 20 years from now. Activist positions have their place in the debate over bloggers' rights, and so do bloggers with courage. Just be aware of where the lines are drawn, because informal "blogger's immunity" may be coming to an end.
"Carroll's right-sized and readable guide covers copyright, trademark and privacy issues in addition to defamation, with some true insights on how to respond to cease and desist letters from copyright and trademark holders.... Be forearmed by being forewarned."
